An appeals court overturned a $10.5 million verdict

in a lawsuit over Roche's Accutane (isotretinoin) after it was determined that a judge improperly barred the company from using evidence about the acne drug’s use, Bloomberg reported.


In its verdict, the New Jersey Superior Court Appellate Division ruled that "Roche was unduly impeded at this trial from adducing and advocating numerical proofs that could have potentially and reasonably led a jury to reach a different verdict.


" The court also concluded that the trial didn’t provide "a full and fair opportunity for Roche to present and advocate the relevant numbers evidence" because judge Carol Higbee only let the jurors hear statistics on the total number of Accutane users during the final stages of the trial.


Commenting on the news, Roche spokesman Christopher Vancheri noted that the court ordered a retrial of the case "because the original verdict followed from an unfair trial."


Roche opted to withdraw Accutane from the market in 2009, but said at the time that safety and efficacy concerns were not factors in the decision.
